Escape Life Inc, operator of LazyFans™ ("Platform"), is committed to fair and transparent enforcement of our policies. This Appeals Policy explains how users and Content Creators can appeal enforcement decisions, the process we follow, and the timelines involved.
1. What Can Be Appealed
You may appeal the following enforcement actions taken against your account or content:
- Content removal (where your content was taken down for an alleged policy violation)
- Account suspension (temporary restriction of your account)
- Account termination (permanent closure of your account)
- Feature restrictions (e.g., removal of the ability to post, message, or earn)
- Payout holds or payment restrictions applied to your Creator account
- DMCA takedowns (see also our DMCA Policy for the counter-notification process)
1.1 Non-Appealable Decisions
The following decisions are final and cannot be appealed:
- Enforcement actions taken in response to a valid court order or law enforcement direction
- Terminations resulting from content involving minors
- Terminations resulting from confirmed human trafficking or sex trafficking activity
- Account closures requested by the account holder themselves
2. Who Can Appeal
Appeals may be submitted by:
- The account holder whose content was removed or account was actioned
- A verified legal representative acting on behalf of the account holder (with written authorisation)
Third parties cannot appeal enforcement decisions taken against another user's account.
3. How to Submit an Appeal
All appeals must be submitted in writing within thirty (30) days of the enforcement action. Appeals submitted after this window will generally not be considered.
To submit an appeal:
- Email support@lazyfans.com with the subject line "Appeal — [type of action] — [your username]"
- Include your account username and registered email address
- Clearly identify the enforcement action you are appealing and the date it was taken
- Explain why you believe the decision was incorrect, including any relevant context
- Attach any supporting evidence (screenshots, links, documents, consent records, etc.)
Incomplete appeals that do not include sufficient information to identify the enforcement action or the basis for the appeal may be returned for additional information before review commences.
4. How We Review Appeals
4.1 Review Process
All appeals are reviewed by a member of our Trust & Safety team who was not involved in the original enforcement decision. The reviewer will:
- Examine the original enforcement action and the reason it was taken
- Review all evidence and context provided in your appeal
- Consider whether the enforcement action was consistent with our policies
- Determine whether to uphold, modify, or overturn the original decision
4.2 Timelines
- Acknowledgement of your appeal: within two (2) business days of receipt
- Standard appeal decision: within seven (7) business days of receipt
- Complex appeals (e.g., involving multiple pieces of content, legal questions, or third-party evidence): up to thirty (30) calendar days, with notification if additional time is required
4.3 Possible Outcomes
Following review, we may:
- Uphold the original decision — the enforcement action remains in place
- Partially overturn the decision — for example, restoring some content but not all
- Fully overturn the decision — the enforcement action is reversed and any removed content is restored
- Modify the decision — for example, reducing a permanent termination to a temporary suspension
5. Appeal Decisions
You will be notified of the outcome of your appeal by email to your registered address. We will explain the reason for the decision.
In most cases, the outcome of a formal appeal is final. However, if you have new evidence that was not available at the time of the appeal, you may submit a further request for review by contacting us with the new information.
6. During the Appeal Period
While your appeal is under review:
- Content that has been removed will remain inaccessible unless and until the appeal is upheld
- Suspended accounts will remain restricted unless we determine that interim restoration is appropriate
- Terminated accounts will remain closed
We do not grant interim access to terminated accounts or removed content pending appeal review, except in exceptional circumstances.
7. Good Faith Appeals
We expect all appeals to be submitted in good faith. Submitting false information, fabricating evidence, or abusing the appeals process may result in further enforcement action, including permanent termination of your account.
8. External Recourse
If you have exhausted our internal appeals process and remain dissatisfied, you may have the right to seek recourse through external channels depending on your jurisdiction, including:
- Consumer protection agencies
- Data protection authorities (for privacy-related complaints)
- Civil courts (subject to the dispute resolution terms in our Terms of Service)
