Escape Life Inc, operator of LazyFans™ ("Platform"), respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512. This policy explains how to submit a copyright infringement notice, how we process such notices, and how to file a counter-notification.

1. Reporting Copyright Infringement

If you believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our Designated Copyright Agent. To be valid under the DMCA, your notice must include all of the following:

1.1 Required Elements of a Valid DMCA Notice

  1. Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered by a single notice
  2. Identification of the infringing material — a description of the material you claim is infringing, with sufficient detail to allow us to locate it on the Platform (e.g., the URL of the specific page or content)
  3. Your contact information — your full legal name, mailing address, telephone number, and email address
  4. Statement of good faith belief — a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
  5. Statement of accuracy and authority — a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner
  6. Physical or electronic signature — your physical or electronic signature

Notices that do not include all required elements may not be actioned. Submitting a false DMCA notice may expose you to liability under 17 U.S.C. § 512(f), including damages and legal fees.

3. How We Process DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  1. Acknowledge receipt of the notice within two (2) business days
  2. Review the notice for completeness and validity
  3. Remove or disable access to the allegedly infringing content promptly where the notice is valid
  4. Notify the Content Creator that their content has been removed and provide them with a copy of the notice
  5. Inform the Content Creator of their right to file a counter-notification

We reserve the right to make a determination of whether content is infringing before taking action, particularly where the claim appears to lack merit or where fair use may apply.

4. Counter-Notification

If your content has been removed as a result of a DMCA notice and you believe the removal was in error (e.g., because you have the right to use the content, or because of misidentification), you may file a counter-notification.

4.1 Required Elements of a Counter-Notification

  1. Identification of the removed material — a description of the content that was removed and its location on the Platform before removal
  2. Statement under penalty of perjury — a statement that you have a good faith belief the content was removed as a result of mistake or misidentification
  3. Consent to jurisdiction — a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district in which the service provider may be found), and that you will accept service of process from the person who submitted the original notice
  4. Your contact information — your full legal name, mailing address, telephone number, and email address
  5. Physical or electronic signature — your physical or electronic signature

4.2 What Happens After a Counter-Notification

Upon receipt of a valid counter-notification, we will:

  • Forward a copy to the original complainant
  • Inform the complainant that we will restore the content in 10–14 business days unless the complainant notifies us that they have filed a court action
  • Restore the content within 10–14 business days if no court action is filed

5. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We maintain records of all DMCA notices received and track repeat infringement activity. Accounts found to be repeatedly uploading infringing content are subject to permanent termination.

6. Abuse of the DMCA Process

The DMCA takedown process is intended to protect legitimate copyright interests. Misuse of this process — including submitting false, frivolous, or bad-faith notices — is a serious matter. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and legal fees, incurred by the affected party.

We take abuse of the DMCA process seriously and reserve the right to take appropriate action against parties who submit false or abusive notices.
